SOLKA, a History on my nation's innaction

BEGINNING


 

SOLKA Laboratories was founded by Dr. Porfirio Solórzano Bermúdez,  on November 20, 1931, registered in a Public Deed of the city of Managua, Nicaragua. His sons, his heirs, all Solórzano Marín, inaugurated the new SOLKA Laboratories facilities in 1967, becoming the largest and most modern pharmaceutical plant in Nicaragua. It has 5 hectares (123 acres) of land, with a construction of 11,240.00 m2. (120,942 sqf.)  (See plan)


All kinds of sterile-filled oral and injectable liquids were produced, as well as antibiotics and tablets of any nature, including those prepared in a controlled humidity environment. All general and special services were handled “in house”.


The quality of preparation and control was proven with the production of serum lines for ABBOT Laboratories. SOLKA achieved amazing growth starting in 1972, which allowed us to extend our exports to Central America. In 1978 it reached sales of up to 4 million US dollars (1978 value), of which 1 million was exported.

 

In 1979, SOLKA was invaded by Sandinista armed fighters accompanied by Cuban militia and subsequently confiscated it, taking possession of the Company (manu militari). Prior to that invasion and confiscation, they had looted SOLKA's warehouses with militarized trucks, taking finished merchandise worth up aproximately a million dollars. The company was finally taken over by a Sandinista Governing Board.

 

With the change of government in Nicaragua in 1990, the recovery process of the SOLKA laboratories began, achieving a return of our ownership (De Juris) without possession. It was in 2001 that the National Assembly (equivalent to Congress) enacted a law that restored all rights to the shareholders of the Solórzano Family recognizing a 60% stake and it assigned to the workers, the right to purchase 40% of the shares. (Law 400-2001).  Even though the outcome was not fair or just because among other things it did not recognized loss of income for the “original owners”, it did not also recognized any damage cause by what had been declared an unjustified confiscation but it at least recognized in the text of a law, the right ownership of what they called “original owners”.

 

During the period 2001-2007, under very stressful conditions, SOLKA came out of state control, and without any capital, outdated machinery and only relying on majority owner’s reputations, again became the leader among local industries of this type. In 2004, SOLKA sold the largest stock of medicines for the Ministry of Health, a figure never sold before by a local supplier. In the year 2006, SOLKA celebrated its 75th Anniversary. See vademecum brochure where you can see the products manufactured under our administration.

 

In 2007, after another violent takeover, SOLKA was  confiscated once more by the government, seizing the minute books, share register, assets and files, and denying access to the property to the 60% shareholders and their representatives, all of this with the consent of authorities and government officials. An important point that we must point out is that both in the improper confiscation in 1979 and the unjust re-confiscation in 2007, the Sandinista administration failed to comply with the financial and fiscal commitments and/or obligations the Company had a those moments and were up to date.

 

There are repeated and explicit violations of the Nicaraguan Constitution, the Nicaraguan government is also in violation of international treaties such as the CAFTA with the US in in reference to the improper use of intellectual property. The Nicaraguan government is currently using SOLKA trademarks for profit without entering into any legal agreement or compensation with the rightful owners.

 

The government of Nicaragua with the arbitrary actions against Laboratorios SOLKA has also created compelling reasons to ther United States government to enforce the NICA ACT (Nicaraguan Investment Conditionality Act of 2018) and RENACER Act (Reinforcement Adherence to Conditions for Electoral Reform Act of 2021).

 

Furthermore -and ironically-, the first case ever cited in United States History where property belonging to a U.S. citizen being seized in a foreign country provoked an act against that country occurred in Nicaragua in 1854.

 

This summary ends with a short redaction of what transpired then:

 

“In 1854, one Lieutenant Hollins, in command of a United States warship, bombarded the town of Greytown, Nicaragua because of the refusal of local authorities to pay reparations for an attack by a mob on the United States consul.766 Upon his return to the United States, Hollins was sued in a federal court by Durand for the value of certain property which was alleged to have been destroyed in the bombardment. His defense was based upon the orders of the President and Secretary of the Navy and was sustained by Justice Nelson, on circuit.767 (…)”

MOTOS

Motos van, motos vienen y nunca se detienen.

Paro frente a un semáforo.  A lo lejos diviso un Oficial de Tránsito, anunciado, evidente, visible.  Luego de unos segundos, desaparece de mi vista con la aparición repentina de un motociclista frente a mi vehículo. ¿De donde provino? ¡No lo sé!

Mi enfoque cambia y se dirige a mis laterales. Veo que pasan por la derecha e izquierda una, dos, tres motos más y todas confluyen frente a mi vehículo en un espacio inexistente desde el punto de vista de la lógica vehicular; no hay nada frente a ellos más que el espacio que ocupan los carros y camiones que hacen uso de su luz verde, en tráfico que se desplaza perpendicular a nuestra posición inmóvil, detenida y expectante al lado rojo del semáforo.  De repente, un motorizado avanza sobre la acera, baja por la cuneta con toda la calma y pomposidad, y se coloca frente a las demás motocicletas como declarando su astucia, proveedora de derechos invisibles sobre los demás.

Qué curioso, ninguna de esa motos respetó a los otros conductores al aventajar en línea continua, en tráfico detenido y no se mosquearon obstruyendo a los conductores que legalmente obedecieron las leyes automáticas y visuales del semáforo que operaba en esa intersección.  Ninguna motocicleta respetó el "espacio" que cada automotor tiene derecho y obligación de acatar.  Uno de ellos transportaba, además de su conductor, a una dama que entre el primero y la segunda, cargaba lo que pude deducir por sus pies, era un infante. El conductor portaba casco, la dama lo llevaba sujetado de su mano derecha, mientras que con su izquierda, asumí sostenía de alguna forma, al presunto infante.

De repente, mi vista se amplió de la carga súbita de motos a mi derredor y noté que el conductor del vehículo a mi derecha -pues era una calle de una vía y doble carril-, sufría en mismo ataque cubriéndonos a ambos, la totalidad del frente.  Tras de mí, habían otras motos que sin ser tan agresivas, evidentemente habían avanzado pero no habían logrado posicionarse delate de todos.  Digo evidentemente, porque al detenerme, logré ver por el espejo retrovisor a una camioneta Toyota color gris; pero ahora, eran cascos de diferentes colores que dejaban entrever ojos, anteojos y visores de diferentes colores y tamaños.

El semáforo súbitamente cambió a verde y no pude arrancar pues la jauría de motos, organizada a su manera, arrancó,  unos más pronto que otros.  Eventualmente si pude avanzar y lo hice con cuidado porque la moto que transportaba a una familia, me había robado la atención y preocupación de conductor consciente de mi entorno.

¡Oh sorpresa!

Al despejarse los moto-conductores, veo que el Policía que había desaparecido entre el tumulto de motores de 200 cc y las llantas de tacos, sale de su posición, se proyecta en medio de la calle, y me hace señas para que me detenga.

-"Su licencia por favor"- me dice.
-"¿Pero Oficial, puede decirme porqué me paró?"- pregunté.

-"Por que pisó la raya continua"-

La Importancia de la Propiedad en Estados Unidos y su Repercusión en su Relación con otros Estados

El problema de la Propiedad Privada en Nicaragua es tema propio y aunque válido y necesario, no es el objeto de estas líneas ni se pretende analizar aquí.

Con la discusión del famoso “Waiver” se ha iniciado un diálogo en nuestro país en el que participan diferentes corrientes.  Desde aquellas que consideran una inherencia extranjera esa actitud estadounidense, hasta los que la abrazan como solidaridad con aquellos que han sido afectos de parte del Estado de Nicaragua so pretexto de alguna razón o función; y también de aquellos que “en río revuelto” se aprovechan y hacen lo suyo propio en detrimento del patrimonio de otros. 

Vale la pena tratar de entender por qué el Gobierno de los Estados Unidos toma posiciones tan beligerantes en su relación con otros Estados -en este caso Nicaragua- en referencia a propiedades de sus nacionales intervenidas, confiscadas y en algunos casos traspasadas a terceros sin su debida autorización o justa indemnización.

El más importante derecho inherente al ser humano considerado por el pensamiento revolucionario que creó la federación de estados de Norte América, hoy conocida como Estados Unidos de América; después de los derechos a la vida y a la libertad, está el derecho a la propiedad. 

Según señala Hobbes, en sus leyes naturales “jus naturale”, la preservación del ser mismo es el epicentro de todas ellas.  Para que la persona pueda preservarse o asegurar su existencia, requiere de la libertad para poder emprender aquellos actos necesarios que produzcan réditos en beneficio de su manutención y la de su familia.  Su excedente,  crea la riqueza, fuente de más beneficios para su existencia y la de los otros.

Esta libertad no puede ser ejercida sin el acceso a los recursos.  Esos recursos emanan de la tenencia de esos bienes que por su requerimiento para la preservación del ser y su familia, son sagrados.

De lo anterior procede que lo más importante en las bases constitucionales y sus enmiendas de los Estados Unidos, son las garantías a la vida, a la libertad y a la propiedad.  Así lo veían  John Adams y George Mason. 

La Quinta Enmienda reza en su parte pertinente a la propiedad: “No person shall…be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.” (Ninguna persona… podrá ser privada de vida, libertad, o propiedad, sin el debido proceso legal; ni podrá la propiedad privada ser tomada para uso público, sin justa compensación.)  Como se puede apreciar, para estos padres de la patria estadounidense, el derecho a la propiedad es solo menos importante que el derecho a vivir y al derecho de ser libre.

De allí se desprende que en la política exterior estadounidense no se pueda considerar una relación normal con un Estado que ha afectado la propiedad de sus ciudadanos sin que ésta haya sido “justamente compensada”.  La Enmienda Helms-Gonzalez (Sección 527) del Acto de Asistencia Extranjera que a su vez actualiza la Enmienda Hickenlooper de 1962, son las bases legales que prohíben la asistencia, directa o indirecta, a países que han afectado propiedad de estadounidenses sin la debida y justa indemnización por parte del Estado afectante.  Estas enmiendas se basan en el principio enarbolado por la Quinta Enmienda, parcialmente citada.  Los Estados Unidos, a través del Departamento de Estado extienden una suspensión de la aplicación de esta ley, conocida como “Waiver”, cuando se percibe y constata que el Estado sujeto de la aplicación de estos actos y enmiendas, está haciendo un esfuerzo considerable dentro de su capacidad para resolver esos casos que por limitantes justificadas no puede realizarlo de inmediato o previo a los desembolsos.

Es importante entender que los Estados Unidos no están solicitando que en Nicaragua se aplique la ley que rige a los estadounidenses.  Tampoco nos piden que elevemos nuestra garantía de tenencia de bienes a la seguridad que ellos tienen diseñado en su legislación.  Lo que exigen a través de esa ley de 1962, es que dineros provenientes de los impuestos de sus ciudadanos no sean malgastados en países que afectan o intervienen sin justa compensación, bienes de sus nacionales.

En Estados Unidos la ciudadanía, ya sea por derecho (nacimiento) o adhesión, es una sola en cuanto a sus derechos –con la excepción de ejercer el cargo a la Presidencia-, dentro de los cuales se encuentra el de demandar a su gobierno la debida protección de su vida, su libertad y su propiedad.  “Government in instituted to protect property of every sort (…)” (El Gobierno ha sido creado para proteger la propiedad de todo tipo …) James Madison

Es difícil que los Estados Unidos, otorgue una dispensa de la aplicación de una ley propia cuando de manera evidente el Procurador de Justicia, el Abogado del Estado, de Nicaragua arrastra los pies para resolver casos que tienen mas de 30 años de existir o que como hemos visto, crea nuevos casos y repite sobre casos previamente solucionados a ciudadanos Estadounidenses.  El pueblo, la sociedad civil, las organizaciones gremiales, las organizaciones de derechos humanos, los políticos; todos, deberíamos enfocar nuestra preocupación no en el país que nos puede negar esta ayuda –que es considerable para nuestra economía-, sino en nuestro gobierno y su abogado, el Procurador de Justicia, para que demuestre el respeto a la garantía de propiedad que Nicaragua extiende en su Constitución, a nacionales y extranjeros, para que países como Estados Unidos no se vean enfrentados a escoger entre aplicar su ley para proteger a sus ciudadanos, o dejar de extender una mano generosa a un pueblo que lo necesita.

Industrial Free Zones in the US II


I have had an idea that think might be implemented to help revitalize the US economy, making use of our own traditional strengths, and at the same time, create a buffer on illegal immigration coming from the south.  This proposed idea is based on three assets we already have:
  1. Human Resources
  2. Technology and Innovation
  3. Our Market
This idea is quite simple:

Create a law by Congress that will allow the US to create a wide border zone with Mexico (and some other areas like Florida where the implementation can be adapted to) and create massive Industrial Parks on a Free Zone model.  These will allow us to contribute with highly qualified labor (engineers, managers, technicians, etc.) and merge them with unskilled labor from the south on a controlled, regulated environment enabling the US to harden the application of the law on illegal immigration but with an alternative.

The US will benefit from the massive construction of these areas.  Services to those areas will spring up as the need for their services arise (food, household services -cable, electricity, telephones-, hardware stores, etc, that will be needed in the living areas of these workers).  The US Economy will benefit from income taxes and Social Security payments that will flow from the creation of hundred of thousands of jobs.  We will benefit from producing goods that not only are currently consumed in the US and being produced in China, the Far East, Central America, the Caribbean, some using the Free Zone status, and instead, they will be "Made in America" again, and even some of it will be exported again.

Some special Agricultural and Cattle Free Zone areas can be created along the border where land that is currently marginal, can, with our technology, become productive using up human labor to pick the crops, package it, transform it and ship it.

We will create an effective buffer zone for illegal immigration currently flowing from the south and will benefit hundred of thousands of Latin Americans, principally Mexicans of course.  But it can also benefit certain islands of the Caribbean that can establish an agreement with the US on shipping labor to Florida.

This idea, on a more structered manner, was sent to Representative John Boehner's Office and effort was made to reach Senator Rubio with no response.  There is hope however that this idea does not get lost somewhere along bureaucracy if it has any merit at all.  If not, just dreaming about it, was fun enough.

Political Tourism

As odd as it can sound, politics can be developed into tourism attraction.

For those who have lived in a democratic nation and whose generation and his (or her) parent's have lived in total political tranquility, countries where one man rule and one man is worshiped by some and hated by others, might constitute a theme worth exploiting as a tourist attraction.

One can imagine a tour bus showing banners alongside roads where a character is displayed as being the savior of the nation;  next to God, this person is portrayed as the embodiment of goodness.  All the infrastructures; roads, bridges, ports and government buildings, owe their existence to this person that without him (or her), the country itself would probably not exist.

The exercise of democracy in that country can be appreciated by the riders of these type of tours on the walls where the same person is portrayed as the devil, reason for all evils and carrier of all bad news in the same nation.

The Political Tourists could purchase mementos from this memorable trip, such as t-shits, hats, pins and other items with the picture of this character, little flags that display the leader's favorite colors (those of his party), and of course, those exceptional pictures of irreverent people that flick their fingers as the tourists are dressed with all these mementos.

These tours could be combined as to visit two or three of these countries.  Usually they have exceptional diplomatic relations among them and visas could be obtained very easily.  These countries although they disdain the nations from where these tourists originate, because of their opposition tho one man rule, they do like their dollars these stable democracies produce and even promote the visitation of tourists from these nations.  The tourists are welcomed but they have to abide by the laws of the land, specially, the one that requires no political, personal or otherwise opinion that could incite any disposition against the ruler from whom all good proceeds.

Besides the small inconvenience that causes being expressionless while visiting the Political Tourist Spot, it's worthwhile because of the fun one can spend afterwards sharing with family and friends back home the incredible simplicity of these regimes where everything can be summarized by one person.  These leaders grant permissions, enacts decrees, makes laws and makes sure everything is implemented according to their will, which of course, is the will of the people he rules, as he has decreed; with the exceptions of a few ill educated and untactful citizens that have heard bad advise from some tourists that did not fully complied by the requirements of the laws of the country and have therefore, acquired unwanted foreign customs.

So our advise, is that Travel Agents should engage in promoting these tours because we are sure they will be in great demand, specially after this blog is published.

Industrial Free Zones on US side of Border with Mexico



1.       The purpose of this essay is to suggest the implementation of Industrial Free Zones on the US side of the Mexico Border.  The main purposes could be outlined as follows:

                                             I.            To partially regulate the influx of Mexican labor as to access US jobs within a regulated environment.   This in turn would -in principle- reduce the illegal immigration and could justify the implementation of harsher regulations, laws, etc.
                                            II.            To promote the creation of skilled labor (management, technical, etc.) for US workers therefore mitigating the national unemployment.
                                          III.            Area Development:  The areas destined for this activity would grow in local services, indirect employment and other benefits for the local communities along the border.

2.       The Framework for the implementation of this proposal is NAFTA.
3.       It can give US companies the chance of acquiring better labor costs without leaving the US, therefore remaining a “Made in the US” company.  Companies’ migration would still be within US borders instead of going overseas looking for cheaper labor costs, neutralizing therefore US Union’s arguments.
4.       The territory where this initiative can be developed is on all of the US territory bordering Mexico.  The initiative however can be exercised on States that are not in contact with Mexico but are through ocean water, accessible to other countries friendly to the US and are in need of creating jobs for their population, example: Florida.
5.       These “Zones” could work in coordination with existing free zones in other countries that are currently benefiting from trade agreements signed with the US.  These zones could do the manufacturing that requires the most labor input, while the “Zones” in the US can engage in more complex assemblies.
6.       The Mechanism Suggested for the implementation could consist of –but is not limited by- the following:
6.1    The enactment of a law by Congress that creates within the Labor Department, the Offices of Industrial Free Zones (this name could be changed to expand its scope, such as “International Free Zones” permitting therefore, service companies and agricultural companies also to make use of this initiative).
6.2    Within that law, there has to be certain amount of basic decision making capacity endowed to the States that are the possessors of the territory where the “Zones” are to be created and where the qualified personnel that will flow into these zones will likely proceed from -or eventually reside in-.
6.3    The law has to amend, create or develop Immigration law as to adapt possible status that permit temporary labor to be accommodated into the scheme presents by this initiative.
6.4    The State Department has to be involved, for there are issues that will have to be agreed with countries where this unskilled labor force proceeds from.  In some cases, those countries would have to amend their own laws so as to allow their nationals to travel while holding onto the privileges they hold while living in these free zones.
6.5    Income taxes could be shared between the US and the country where these workers proceed from.  A suggested rate could be 40% the US, 60% the country of origin.  All sales taxes originating in products sold for the internal consumption within these “Zones” will go to the States.
6.6    All raw materials going into these “Zones” will of course be free of taxes as well as all finished goods.

La Tortuga Voladora, un Cuento para Niños y algunos Adultos

LA TORTUGA VOLADORA



En una hermosa playa, al sur del país llamada Playa Escondida, una vez al año cuando la luna está lo mas llena posible en el cielo, arriman miles de tortugas a desovar.  Cada una de ellas deja docenas de huevos de los cuales saldrán las nuevas generaciones.

Cuando nacen, los machos jamás volverán a tocar tierra; y las hembras, al llegar a su madurez reproductiva, regresarán cada año a esta playa que las vio nacer.

Pero una vez, hace muchos años, una de ellas que llegaba tarde, escavó rápidamente su hueco en la arena y apresuradamente dejó caer las varias docenas de huevos que traía en su fecundo vientre.  No percató sin embargo, que al tapar los huevos con la arena que esparció con sus aletas posteriores, uno de ellos rodó fuera, y al posarse, inadvertidamente, se camufló debajo de unas hojas secas.

Al amanecer, con la brisa matutina las hojas que taparon el huevo se dispersaron dejándolo expuesto.  El sol que al salir es tibio, calentó suavemente el frío que la noche había calado en las entrañas de este huevecito, pero amenazaba con cocinarlo, pues este mismo suave y tibio sol, al pasar las horas, se convertía en calcinador e inclemente.

Una pajarita de color azul y con pinceladas de amarillo y rojo en su pecho, llamada Anita, volaba por la zona buscando ramas y hojas secas pues estaba ya en la construcción de su nido.  Al bajar a la arena para escoger las últimas, mejores y más secas ramitas, se topó con el huevo que yacía solo.  Vio a la derecha y a la izquierda y solo vio arena.  Movió la cabecita de un lado a otro para apreciarlo mejor y se preguntó que hacía un huevo solo en medio de la arena.  Su naturaleza femenina cargada de maternidad la hizo compadecerse del posible destino de ese huevecito: morir de calor en el día o de frío por la noche; o ser devorado por un lagarto, serpiente o algún mamífero hambriento.

Tomándose un riesgo desconocido pues no sabía de qué ave o reptil podía ser ese huevo, lo tomo delicadamente en su pico y levantó vuelo.  Su nido ya casi por terminar, reposaba en un hermoso y fuerte gancho de árbol de Jícaro no muy lejos de la playa.  Delicadamente lo dejó caer y terminó de acomodar las ramas y hojas que había llevado en su viaje anterior.  Voló unas dos veces más para traer las ramas que faltaban para dar el toque final a lo que se convertiría en el hogar de su camada, y descansó.

Durante la noche, puso tres huevos.  Dos de ellos tamaño normal y uno un poco más pequeño.  Junto con el huevo que había recogido, los acomodó bajo los plumones de su pecho, y los comenzó a arrullar.  Pasaron los días y las noches.  Solo se le vio abandonar el nido por momentos para beber agua, recoger algún gusanito y para librar su cuerpo de excrementos, pues su nido debía mantenerse limpio.

Los días y las noches que parecieron largos, dejaron de serlo cuando empezó a escucharse dentro de los huevecitos, los primeros chirridos de sus vástagos.  Pronto empezaban a quebrar el cascarón con sus picos.

Primero salió un pajarito cuyo plumón era negro, llamado Pedro y cuando lo vio Anita con ternura lo acicaló y arrulló, seguido del segundo quién correctamente se llamó Segundo y de penúltimo, el pequeño huevo a quién bautizó Tito, por chico y bonito.  Unas horas más tarde, nació el huevo que había recogido en la playa.  Verde y bonita, Solita, que viendo a Anita, la buscó como madre, y no en vano, pues el cariño y ternura fueron recíprocos.

Pasaron los días y Anita muy presta volaba constantemente para que en el nido no faltara el alimento que traía en su pico y el agua en su pecho.  Crecieron juntos, como buenos hermanos, Pedro, Segundo, Tito y Solita.  Jugaban y se revolcaban, pero pronto el nido ya no era suficiente.

Solita empezó a realizar que era diferente pues en sus aletas no veía plumas y su pico se tornaba cada día más verde.  Veía a sus hermanos que de plumones desarrollaron hermosas plumas y cada día se asemejaban más a Anita, su madre.

Anita, veía a través de los ojos de Solita las preguntas sin respuestas pero solo las contestó con mas afecto y cariño, confiando en que con la base sólida del amor, todo se podía.

Llego la hora que las plumas de Pedro, Tito y Segundo los llamaron a probar el viento y uno por uno saltaron hasta alguna rama cercana desde donde levantaron vuelo siempre acompañados de su madre.  Solita veía todo esto y se preguntaba qué sería de ella.

Cuando Anita regresó al nido, se inclinó al oído de Solita y susurró estas palabras: -Hija, las diferencias no nos hacen menos, sino especiales, nutren el corazón de mayor comprensión por los demás y de mayor tenacidad para la vida.

Entonces, sujetándola de su concha, la arrimó al borde del nido y con más seguridad aún, le dijo estas palabras que siguieron sonando en esa bahía por muchos años: -Cuando hay fe, no hay límites.

Desde entonces, gente que ha visitado Playa Escondida ha sido tildada de loca o afectada por el calor, u otra cosa similar, porque aseguran, que temprano en esa bahía, surca los cielos una bella tortuga que batiendo sus aletas anteriores, vuela como pájaro y que con gracia se posa sobre la arena desde donde se dirige al vasto océano.  Los pájaros desde sus ramas parecen saludarla y despedirla y ésta, levantando una de sus aletas, pareciera despedirse de ellos.

No se sabe si esta historia es cierta, pero si sabemos que la fe logra imposibles y el amor, todo lo puede.
